Equality isn’t a policy, it’s a promise you have to keep – and one you may be asked to prove

On 5 August, the EHRC updated its Code of Practice for Services, Public Functions and Associations, sharpening how organisations must meet their existing duties under the Equality Act 2010.

The update does not change the law, but it does reinforce an important question for organisations: if someone was refused a service today, treated differently, or overlooked because of who they are, would your organisation know what happened, who made the decision, what evidence supported it, and whether the correct process was followed?

Those are the questions sitting underneath the Equality Act 2010, and also the questions the updated EHRC Code of Practice for Services, Public Functions and Associations are really asking now that it is officially in force.

Equality and human rights law was never really about paperwork. It is about whether people can trust that they will be treated fairly, consistently and with dignity, regardless of who they are, and whether organisations can demonstrate that those principles are embedded into everyday practice.

The Code itself

For many organisations, the updated EHRC code provides an opportunity to look beyond policies on paper and consider whether their processes, decisions and behaviours genuinely reflect what the law expects.

Having a policy is only the starting point. The real test is whether an organisation can demonstrate how those commitments are being put into practice, how responsibilities are assigned, how improvements are identified, and how decisions can be explained when they need to be.

Compliance is an ongoing cycle

Compliance is not something that can be completed once and then forgotten. Organisations that manage it effectively treat compliance as an ongoing cycle of reviewing current practice, identifying areas for improvement, assigning responsibility and maintaining visibility of progress.

Every organisation has different risks, people and processes, so there is no single template that works for everyone. However, there is a shared need to turn scattered obligations into something visible, owned and manageable.

The challenge for many organisations is not understanding that these responsibilities exist; it is having a reliable way to connect policies, people, actions, training, reviews and evidence into one clear picture.

This is where compliance monitoring technology can make a real difference

Prime Systems helps organisations move from reactive compliance to proactive management by bringing key activities together in one structured platform. Rather than relying on disconnected spreadsheets, emails or folders of documents, organisations can schedule checks, monitor completion, identify issues early, assign ownership and maintain a clear record of activity.

The Compliance Monitoring module gives organisations visibility and control across their compliance activity, allowing checks and reviews to be scheduled around their own requirements and timescales. Whether monitoring takes place daily, weekly, monthly or annually, the system helps ensure important responsibilities remain visible and do not become overlooked tasks.

Where issues are identified, Prime Systems helps turn findings into action. Concerns can be assigned to the appropriate person, deadlines can be set, progress can be monitored and supporting information, such as documents or photographs, can be stored alongside the relevant action, creating a clear audit trail from identification through to resolution.

Incident reporting is another important part of that picture. If a customer or employee raises a concern about how they were treated, a service they were denied, or another potential contravention, organisations need a way to report, document and track what happened. Recording incidents alongside the relevant actions and evidence helps create a clear record of what was reported, how it was investigated, what decisions were made and whether any follow-up was required. It also brings the question back to that first test: would your organisation know what happened?

For leaders, this provides more than a compliance record. It creates confidence that they understand what is happening across the organisation, where improvements are needed and how responsibilities are being managed.

Alongside compliance monitoring, Prime Systems brings together tools for managing policies, procedures, audits, risk assessments, incidents and actions, helping organisations create a more connected approach to governance, accountability and continuous improvement.

The result is that compliance stops being something prepared for at the last minute and becomes part of how the organisation operates every day.

Staying ahead, not catching up

The EHRC Code is just the latest example of a wider shift, as expectations around workplace practice, transparency, accountability and good governance continue to evolve faster than many traditional processes can comfortably handle.

Organisations that rely on static documents and disconnected systems can find themselves reacting after the fact, while those that build accountability into everyday practice are better placed to respond to change, demonstrate compliance and make informed decisions.

Flexible, structured systems help organisations adapt as expectations change, creating the difference between constantly playing catch-up and having the confidence to move forward.

The real point of all this

Compliance was never just about avoiding a fine or passing an inspection, it is about the confidence that comes from knowing things are being done properly.

For employees, it means working somewhere that is genuinely committed to fairness and inclusion. For the people relying on your services, it means knowing they will be treated with respect, consistency and dignity. For leaders, it means being able to stand behind the decisions their organisation makes and explain how responsibilities are being met.
